Levin: Biden Worse Than Nixon, 'Most Lawless President in Modern American History'

Over the weekend, Mark Levin contended on his Fox News program “Life, Liberty & Levin” that Joe Biden “is the most lawless president in modern American history.”

Levin — who served as chief of staff to Attorney General Edwin Meese during the Reagan administration — pointed to the Constitution’s Article II, section 3 to lay the foundation for his case.

The section provides, in part, “…he [the president] shall take care that the laws be faithfully executed.”

“Shall take care that the laws be faithfully executed. Is that what Joe Biden’s doing?” Levin asked. “No. Joe Biden is the most lawless president in modern American history. You can talk about [Richard] Nixon. You can talk about whomever you want.”

Nixon resigned in 1974 under threat of impeachment for his alleged role in a White House cover-up involving the break-in of the Democratic National Committee headquarters in the Watergate complex by members of the then-president’s 1972 re-election committee.

Levin cited multiple ways he believes that Biden is failing to see that federal law is faithfully executed, pointing first to immigration.

He noted that immigration law is quite extensive, providing caps to the number of people that can come into the country from various places around the world.

Further, there are also laws preventing those with criminal records or communicable diseases from entering, but the president is not enforcing these laws — instead we have an “open border,” Levin said.

There were over 1.7 million apprehensions at the southwest border during fiscal year 2021, which is an all-time high, according to U.S. Customs and Border Protection figures.

The surge, which consisted of 1.2 million more people than former President Donald Trump’s last year in office, came after Biden issued executive orders on his first day in office in January halting construction on the border wall and terminating the “remain in Mexico” policy initiated during the former administration.

Levin went on to fault Attorney General Merrick Garland for not investigating why the nation’s immigration laws are not being enforced. He pointed out that Garland would rather spend time suing the state of Georgia over its election law reforms and inserting himself in the battle over the Texas abortion law, which makes it illegal to abort an unborn child once a heartbeat is detected.

“The Democrats, the Biden administration believe in abortion on demand, even a second before birth, and they believe you should pay for it. It is the most radical administration. It’s the most radical government, when it comes to abortion, in the entire world,” Levin said.

Levin also hit Garland for threatening parents “who dare to challenge school boards and teachers unions” over issues like critical race theory and COVID mandates.

“In other words, we have a lawless Department of Justice that is focused on a political and policy agenda that also won’t enforce existing law,” the Fox News host said.

As further evidence of the politicization of the DOJ, Levin pointed to the over 600 criminal prosecutions of those who entered the Capitol on Jan. 6 to protest the certification of the Electoral College vote.

“There weren’t 630 rioters,” he said, citing video released from the day and the crimes actually being charged in most cases.

“We’ve seen that the vast majority of people who were in the Capitol were waved into the Capitol building by Capitol Hill police. How are you trespassing when the police, who are there to enforce trespassing, are allowing you into the building?” Levin asked.

“People who actually riot and commit acts of violence should be prosecuted,” he added.

“Tell me, are 630 members of Black Lives Matter or Antifa, are they holed up anywhere?” Levin questioned. “Are they being charged with anything? 630? Those people who were rioting, burning buildings, attacking cops, some of whom killed fellow citizens and so forth?”

The Justice Department has deployed “more resources on this matter [of the Jan. 6 Capitol incursion] than any matter they’ve had in American history. Unbelievable,” he said.

Levin also argued Biden’s executive order clearing the way for critical race theory to be taught in the military and throughout the federal government is a violation of the 14th Amendment, which ensures equal protection under the law.

Additionally, the conservative firebrand highlighted the president’s commission established to look into making changes to the U.S. Supreme Court.

“Why was that commission put together, and why is it still there?’ Levin asked. “To threaten the United States Supreme Court. ‘You boys and girls on the court, you either do what we want you to do or we’re going to ramp up that commission or we’re going to pack to court.'”

“What else are they doing?” he wondered “Well, the question is what aren’t they doing that doesn’t violate the law [and] skirt the Constitution?”
